If you have not requested or could not have requested a repair or replacement, you may request a pro rata reduction of the consideration or you may repair the defect or have it repaired at the company&#8217;s expense, or, ultimately, withdraw from the contract.<\/p>\n<p>You may switch from the chosen warranty for material defects right to another; however, you are obliged to pay any cost caused by this switch, unless the business gave a reason for the switch or the switch was otherwise justified.[\/vc_toggle][vc_toggle title=&#8221;What is the deadline for you to enforce your warranty claim?&#8221;]You must report the defect without delay when you discover it, but no later than two months after the defect is discovered. However, I would like to draw your attention to the fact that you may no longer exercise your warranty rights beyond the limitation period of two years from the performance of the contract. In the case of second hand items, this period is 6 months.[\/vc_toggle][vc_toggle title=&#8221;Against whom can you assert your warranty claim?&#8221;]You can enforce your warranty for material defects claim against the business.[\/vc_toggle][vc_toggle title=&#8221;What are the other conditions for enforcing your warranty rights?&#8221;]Within six months of the performance; there are no other conditions for enforcing your warranty claim beyond the notification of the defect, if you prove that the product or service was provided by Wellis Magyarorsz\u00e1g Zrt. However, after six months from the date of performance, you must prove that the defect you identified already existed at the time of performance.[\/vc_toggle][vc_toggle title=&#8221;In what cases can you exercise your product warranty rights?&#8221;]In the event of a defect in a movable thing (product), you may, at your option, assert the right or product warranty claim specified in Section 1.[\/vc_toggle][vc_toggle title=&#8221;What rights do you have based on your product warranty claim?&#8221;]As a product warranty claim, you may only request the repair or replacement of a defective product.[\/vc_toggle][vc_toggle title=&#8221;In what cases is the product considered defective?&#8221;]A product is defective if it does not meet the quality requirements in force at the time of placing it on the market or if it does not have the characteristics specified by the manufacturer.[\/vc_toggle][vc_toggle title=&#8221;What is the deadline for you to enforce your product warranty claim?&#8221;]You can assert your product warranty claim within two years of the product being placed on the market by the manufacturer. Upon the expiry of this period, this right is lost.[\/vc_toggle][vc_toggle title=&#8221;Against whom and under what other conditions can you assert your product warranty claim?&#8221;]You can only make a product warranty claim against the manufacturer or distributor of the movable thing. You must prove the defect in the product in the event of a product warranty claim.[\/vc_toggle][vc_toggle title=&#8221;In what cases is the manufacturer (distributor) released from its product warranty obligation?&#8221;]The manufacturer (distributor) is only released from its product warranty obligation if it can prove that:<\/p>\n<ul>\n<li>the product was not manufactured or marketed in the course of its business, or<\/li>\n<li>the defect was not detectable at the time of placing it on the market according to the state of the art or<\/li>\n<li>the product\u2019s defect is the result of the application of a law or mandatory official standard.<\/li>\n<\/ul>\n<p>It is sufficient for the manufacturer (distributor) to prove a reason for the exemption.<\/p>\n<p>Please note that you cannot claim warranty for material defects and product warranty at the same time, in parallel, due to the same defect. However, if your product warranty claim is successfully enforced, you can assert a warranty claim against the manufacturer for the replaced product or repaired part.[\/vc_toggle][vc_toggle title=&#8221;In what cases can you exercise your right to warranty for material defects?&#8221;]In the event of defective performance of certain products, Wellis Magyarorsz\u00e1g Zrt. is obliged to provide a warranty on the basis of a contract or legislation.[\/vc_toggle][vc_toggle title=&#8221;What rights do you have under the warranty and within what period?&#8221;]For products defined in Annex I of Government Decree 151\/2003 (IX.22.) on the mandatory warranty for certain durable consumer goods, the warranty period shall be at least one year.[\/vc_toggle][vc_toggle title=&#8221;When is the business released from its warranty obligation?&#8221;]The company is only released from its warranty obligation if it proves that the cause of the defect arose after performance.<\/p>\n<p>Please note that you cannot assert a warranty and guarantee claim or a product warranty and guarantee claim at the same time, in parallel due to the same defect, otherwise you are entitled to the rights arising from the warranty regardless of the rights specified in Sections 1 and 2.[\/vc_toggle][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row full_width=&#8221;stretch_row&#8221;
